Terms and conditions

Article 1 – Reservation request: The site allows you to request a reservation for a stay in our house. We will respond to your request as soon as possible. If the desired dates of stay are available, We will send You the rental contract by e-mail.


Article 2 – Conclusion of the contract: The reservation becomes effective when the Customer has sent the Lessor a deposit of 30% by bank transfer of the total amount of the price of the stay, a copy of the contract completed and signed by hand by post, before the date indicated on the contract as well as a copy of your identity card or passport. A return by e-mail and/or telephone from the Lessor will be made in order to notify the Customer of the receipt of the deposit and the completed and signed rental contract. The contract concluded between the parties to this deed cannot in any case benefit even partially to third parties, natural or legal persons, except with the written agreement of the Lessor. Any violation of this last paragraph would be likely to result in the immediate termination of the stay at the fault of the customer, the price of the stay remaining definitively acquired by the Lessor.


Article 3 – Cancellation by the Customer:Except in cases of force majeure, if the Customer cancels his stay, he must pay the full amount of the rental unless the house has been re-rented. The customer who has not paid the balance on the agreed date is considered to have canceled his stay.


Article 4 – Cancellation by the Lessor:If the Lessor cancels the reservation made by the Customer, he undertakes to notify the Customer as soon as possible and to compensate him by reimbursing the deposit paid as well as the balance of the rental if it has taken place.


Article 5 – Duration of Stay:The Customer signing the contract concluded for a fixed term may not under any circumstances claim any right to remain in the premises.


Article 6 – Interruption of stay:In the event of interruption of the stay by the Customer, no refund will be made.


Article 7 – Arrival and departure:The Customer must present himself on the day specified and at the times mentioned on the rental contract (5 p.m. to 7 p.m.). In the event of late or deferred arrival or last-minute impediment, the Customer must notify the Lessor, whose address, telephone and e-mail appear on the website and on the rental contract. The Customer must leave on the day specified and at the times mentioned on the rental contract (before 10 a.m.).


Article 8 – Means of payment:The payment of the deposit, the balance and the tourist tax is made by bank transfer. Payment of the security deposit is made by check on the day of arrival.


Article 9 – Prices:The prices are indicated in the rental contract and correspond to the overall cost of renting the gîte for the duration mentioned in the contract.


Article 10 – Payment of the deposit:The requested deposit represents 30% of the total price of the stay. The payment of the deposit is made by bank transfer and before the date indicated on the contract (8 to 10 days after receipt of the contract by e-mail). If the payment of the deposit is not received by the Lessor within the deadlines indicated on the rental contract, the reservation will not be retained. If the reservation is made less than a month before the arrival date, the payment of the deposit and the balance is made in one go.


Article 11 – Payment of the balance:The payment of the balance is made by bank transfer on the date indicated (30 days before the date of arrival) on the rental contract. If the reservation is made less than a week before the arrival date, the payment of the deposit and the balance is made in one go.


Article 12 – End of stay cleaning fee:The end-of-stay cleaning fee at the rate of €100 is compulsory. The payment of the cleaning fee is made by bank transfer and is included in the amount of the balance that remains to be paid to the Customer mentioned on the rental contract. The Customer is however required to leave the house tidy (bins and refrigerator emptied, and dishes clean).


Article 13 – Options:Options include bed linen and bathroom linen. The payment of the subscribed options is made by bank transfer and is included in the amount of the balance that remains to be paid to the Customer mentioned on the rental contract.


Article 14 – Tourist tax:The payment of the tourist tax indicated on the contract is made by bank transfer at the same time as the payment of the balance. If the stay is shortened by the Client, the Lessor will reimburse the remaining amount to the Client.


Article 15 – Cleaning products:A kit of cleaning products (dishwashing liquid, sponges, toilet product, dishwasher tablets, detergent, toilet paper, trash bags, paper towels, floor product) is provided on your arrival to start your stay.


Article 16 – Table linen:Dishcloths and hand towels for the kitchen are provided on your arrival.


Article 17 – Exterior and security:Private parking is at your disposal. The exteriors of the house and are the responsibility of the parents. The swimming pool is equipped with an alarm, this in no way exempts your vigilance. Information concerning the operation of the alarm will be given to You upon your arrival.


Article 18 – Security deposit:On arrival of the Customer at his place of stay, a security deposit, the amount of which (€1,000) is indicated on the rental contract, is requested by the owner. Payment of the security deposit is made by check on the day of arrival. On arrival of the client, a security deposit, the amount of which is indicated on the contract, is requested by the Lessor. After the contradictory establishment of the exit inventory, this deposit is returned within one month if the exit inventory is carried out, minus the cost of restoring the premises, if damage have been observed. In the event of early departure (prior to the times mentioned on the rental contract) preventing the establishment of the inventory on the same day of the Customer's departure, the security deposit is returned by the Lessor within a period not exceeding a month. We will contact You by e-mail or by telephone no later than one week before your arrival date to remind You that You must present the check corresponding to the security deposit, the amount of which is mentioned on the rental contract.


Article 19 – State of play:An inventory is drawn up jointly and signed by the client and the owner or his representative on arrival and departure from the gîte. This inventory is the only reference in the event of a dispute concerning the inventory. The state of cleanliness of the gîte on the client's arrival must be noted in the inventory. These appointments may be modified in the event of force majeure and provided that both parties are duly informed.


Article 20 – Use of premises:The Customer must ensure the peaceful character of the gîte and use it in accordance with the destination of the premises. The Customer undertakes not to modify the premises or the arrangement of the furniture in any way and to only use the premises for residential purposes without causing any disturbance to the neighborhood (noise, smells, smoke, lights, etc.). Similarly, article 222-16 amended by law no. 2014-873 of August 4, 2014 – art. 39 stipulates that repeated malicious telephone calls, repeated sending of malicious messages sent by means of electronic communications or sound attacks with a view to disturbing the tranquility of others are punishable by one year's imprisonment and 15,000 euros in fine. Article 21 – Capacity:This contract is established for a maximum capacity of 6 people. If the number of customers exceeds the capacity, the owner is able to refuse the additional people. Any modification or breach of contract will be considered at the customer's initiative.


Article 22 – Pets:We do not accept pets. In the event of non-compliance with this rule, We may refuse the stay to the Customer. In this case, no refund will be made.


Article 23 – Insurance:The Customer undertakes to take out insurance against rental risks (fire, water damage) and to produce, when booking, a copy or a photocopy of the insurance policy paid for with a reputably solvent company. The lack of insurance, in the event of a claim, will give rise to damages.


Article 24 – Individual police file:Pursuant to article R. 611-42 of the code for the entry and stay of foreigners and the right to asylum, and for the purposes of preventing disturbances to public order, judicial inquiries and research in interest of persons, the Lessor is required to have the foreigner complete and sign, upon arrival, an individual police form.


Article 25 – Disputes:Any complaint relating to the inventory must be submitted to the Lessor within three days of the date of the start of the stay. Any other complaint must be addressed to him as soon as possible, by e-mail.


Article 26 – Protection of personal data:In accordance with the law "Informatique et Libertés" of January 6, 1978 amended in 2004, You have the right to access and rectify data concerning You. If You wish to exercise this right, You only need to make a request by e-mail. The Lessor La villa l'Espinas undertakes not to transmit the information that You have communicated to it to other companies or organisations.


Article 27 – Intellectual property:We take responsibility for committing ourselves to respecting the information published on the site. We authorize the Customer to print part of the content of the site (text, images, logo) for his personal use only. The Customer therefore undertakes not to reproduce, copy, modify or distribute an article, an image, the logo without the authorization of the Lessor.
